KEVIN R. MINTZ

Mr. Mintz joined the firm in 1995 and has been a shareholder since 2001, with the primary focus of his practice being counseling and representing medical and legal professionals in both malpractice actions and administrative proceedings. In addition, he maintains an active general civil defense practice involving a wide range of personal injury, property damage and products liability matters, including defending property owners in premises liability and habitability claims; security companies and other business entities in claims involving third-party criminal assaults, as well as allegations of excessive force/false imprisonment; transportation companies in catastrophic multi-victim accident cases; employers and public entities in employment and civil rights claims; and contractors, subcontractors and product manufacturers in construction defect and injury actions.

In this capacity, Mr. Mintz has represented a diverse group of clients, including physicians and other allied health care providers, hospitals and other health care facilities, lawyers from a broad spectrum of practice areas, various types of businesses of all sizes, construction professionals, product manufacturers, and non-profit organizations. He has appeared on behalf of such clients in both state and federal courts throughout California, handling all aspects of litigation from inception through trial and post-trial appeals. He also provides risk management counseling.

Selected Representation:
-Security guard/security company defendants in wrongful death action based on guard’s fatal shooting of 19-year-old male, Sacramento County Superior Court (tried to defense verdict).
-Cosmetic & plastic surgeon defendant in medical malpractice action alleging negligent post-operative care and wound management following breast reduction procedure, Alameda County Superior Court (tried to defense verdict).
-Shipping company/driver defendants in wrongful death action based on fatal collision between bicyclist and shipping company’s semi-truck, Napa County Superior Court (summary judgment granted for both client-defendants).
-Representation of private security guard company/guard defendants in federal civil rights action relating to its provision of security at Nevada County Superior Court (dismissed via FRCP 12(b)(6) motion, affirmed on appeal to 9th Circuit).

Community Service:
Mr. Mintz has been an active volunteer with both the Montclair Soccer Club, having served as a licensed head coach for 16 years as well as in an administrative capacity in various positions, and with the North Oakland/South Oakland Little League (NOLL/SOLL), as both a coach and umpire. He was also a long-serving member of the Jack London Youth Soccer Sports League Board of Directors.
