DAMON M. THURSTON

Mr. Thurston joined Rankin, Sproat, Mires, Reynolds, Shuey, and Mintz in 1999. His practice areas include counseling and representing medical and legal professionals in malpractice actions, the defense of general contractors, subcontractors and product manufacturers in large-scale construction defect actions, the defense of employers and public entities in employment and civil rights claims, business litigation, toxic tort defense, and general civil defense work in a wide range of personal injury and products liability actions. Mr. Thurston is also a registered patent attorney, and represents clients before the United States Patent and Trademark Office in applying for both patents and trademarks. Mr. Thurston has represented a wide range of clients, including physicians and other allied health care providers, lawyers from a broad spectrum of practice areas, construction professionals and product manufacturers, public officials and officers, security guard companies and real estate professionals, electronics manufacturers and local small businesses.

Selected Representation:
– General Contractor and excess carrier in an indemnity/subrogation action against a roofing Subcontractor and its excess carrier arising out of a roof collapse during construction that resulted in severe injuries and the death of one worker, Alameda County Superior Court ($3.7 million verdict in favor of General Contractor and its excess carrier).
– Favorable appellate ruling, Franco v. American Medical Response, et al.: Dismissal affirmed for failure to serve within two years per Code of Civil Procedure section 583.420). (Court of Appeal of the State of California, Second Appellate District, Division Seven, Case No. B309840).
